At Boxia (“Boxia” “we,” “us,” “our”), we know that our users (“you,” “your”) care about how their personal information is used and shared, and we take your privacy very seriously. This privacy policy describes how Boxia collects and uses the personal information you provide,  in compliance with the GDPR and the “Informatique et Libertés” law n°78-17.

By visiting or using the Website or Service in any manner, you acknowledge that you accept the practices and policies outlined in this privacy policy and you hereby consent that we will collect, use, and share your information in the following ways.

 

1. Definitions

“Account” means the account created by the Client or for the Client by a User.

“Boxia” means the “Boxia” brand of DELIVREURS SAS, a company incorporated in France (company registration number: 813 278 942) with a registered office located at 9 rue des Colonnes, 75002 Paris.

“Client” means any customer of Boxia registered on the Website and/or using the Service.

Client’s Data” means any data, written or electronic document, software, image, video, text or sound that a Client stores, transmits, uploads or otherwise makes available through the Website, Software and Service. 

“Company” means DELIVREURS SAS, a company incorporated in France (company registration number: 813 278 942) with a registered office located at 9 rue des Colonnes, 75002 Paris.

End Customer” means the person or company with whom the Client interacts using the Service.

“Personal Data” means any information relating to an identified or identifiable natural person.

“Privacy Policy” or “Policy” means this privacy policy as amended from time to time.

“Public Area” means the area of the Website or Software that can be accessed both by Users and Visitors, without needing to log in.

“Restricted Area” means the area of the Website or Software that can be accessed only by Users, and where access requires to log in.

“Service(s)” means any service provided by Boxia to the Client including but not limited to the use of and access to the Website such as the Software or any documentation. Any new or modified feature added to the Service is also subject to this Privacy Policy.

“Software” means any software provided by Boxia to the Client, Users or End Customers.

“User” means any person authorized by the Client to use the Service through the Account, and primarily uses the Restricted Area of the Website or Software for the purpose of accessing the Service in such capacity.           

“Website” means the Boxia website whose URL is https://www.boxia.co and any other site owned or managed by Boxia.

“Visitor” means any individual other than a User, who uses the Public Area, but has no access to the Restricted Area of the Website or Service.


2. Data controller

The data controller in accordance with applicable data protection laws is DELIVREURS SAS (“Company”), a joint-stock company incorporated in France (company registration number: 813 278 942) with a registered office located at 9 rue des Colonnes, 75002 Paris, under the European Data Protection Regulation EU 2016/679 (“GDPR”). The Company is responsible for ensuring that processing of personal data complies with this Privacy Policy and applicable data protection legislation.

  

3. Information we collect

What this Privacy Policy covers

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Website or Service. This policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

We do not knowingly collect or solicit personal information from anyone under the age of 16 or knowingly allow such persons to register for the Service. No one under age 16 may provide any personal information to us or on the Service. If we learn that we have collected personal information from a child under age 16, we will delete that information as quickly as possible.

 

Legal basis

The legal bases for Boxia’s processing of personal data are primarily that the processing is necessary for providing the Service in accordance with Boxia’s terms of service and that the processing is carried out in Boxia’s legitimate interest. We may also process data upon your consent, asking for it as appropriate.

 

Information you provide to us

Your Personal Information:

We receive and store any information you knowingly provide to us. For example, we collect Personal Information such as your first name and last name, email address, password, company address, contact phone number and browser information. You can choose not to provide us with certain information such as your credit card information or other payment method information, but then you may not be able to register with us or to take advantage of some of our features.

Your End Customers’ Personal Information: 

In order to provide you with the Service, we also receive and store any information you choose to provide us with respect to End Customers. The End Customers’ information (“End Customers Information”) we receive and store typically includes names, phone numbers and email addresses, addresses of your customers, but will consist of any information you choose to provide us with. If you are using emails’ open, click tracking, Boxia collects the recipient’s activities (e.g.: opens, clicks). Boxia has no direct relationship with the individuals whose Personal Data it hosts as part of Client’s Data. Each Client is responsible for providing notice to its customers and third persons concerning the purpose for which Client collects their Personal Data and how this Personal Data is processed in or through the Service as part of Client’s Data.

Integrated Services: 

You may be given the option to integrate your Account with other third party software such as Zendesk, Shopify, Prestashop, Magento or otherwise have the option to authorize an Integrated Service to provide Personal Data or other information to us. By authorizing us to connect with an Integrated Service, you authorize us to access and store information that the Integrated Service makes available to us, including End Customer’s Personal Data, and other data such as email content and to use and disclose it in accordance with this Policy. You should check your privacy settings on each Integrated Service to understand what information that Integrated Service makes available to us, and make changes as appropriate. Please review each Integrated Service’s terms of use and privacy policies carefully before using their services and connecting to our Service.

 

Information collected automatically

Whenever you interact with our Website or Software, we automatically receive and record information on our server logs from your browser including your IP address, “cookie” information, and the page you requested. “Cookies” are identifiers we transfer to your computer or mobile device that allow us to recognize your browser or mobile device and tell us how and when pages in our Website or Software are visited by you. You may be able to change the preferences on your browser or mobile device to prevent or limit your computer or device’s acceptance of cookies, but this may prevent you from taking advantage of some of our Website or Software’s features. If you click on a link to a third party website, such third party may also transmit cookies to you. This Policy does not cover the use of cookies by any third parties.

When you visit the Website or Software, whether as a User or a Visitor, our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). For example, Log Data may include information such as your computer’s IP address, browser type or the webpage you were visiting before you came to our Website or Software, pages of our Website or Software that you visit, the time spent on those pages, information you search for on our Website or Software, access times and dates, and other statistics. We use this information to monitor and analyze use of the Website and the Service and for the Website and Software’s technical administration, to increase our Website and Software’s functionality and user-friendliness, and to better tailor it to our visitors’ needs.

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Service does not support Do Not Track requests at this time, which means that we may collect information about your online activity both while you are using the Service and after you leave our Service.

Additionally, as part of our provision of the Service to you, if you install certain software code provided by us on your website, we will also track and collect End Customer’s usage information on your website. We also use third parties to collect publicly available information relating to your End Customers.

 

Third Party Analytics Services

We use third party analytics services in order to better understand user engagement with the Service. When a user browses or uses the Service, these third party analytics services may collect the user’s IP address, browser type, and approximate location (based on the IP address). They may also use web logs or web beacons and may set and access cookies on your computer or other device.

As you browse Boxia and other websites, online ad networks we work with may place anonymous cookies on your computer, and use similar technologies, in order to understand your interests based on your (anonymous) online activities, and thus to tailor more relevant ads to you.


4. How we use the information we collect

We process personal data for three main purposes.

 

Service provision 

Some areas of the Service require the processing of personal data in order to provide services to you. In this case, the processing may concern, for instance, data that is necessary for us to deliver the Service to you, to provide customer support or to invoice you. The processing in this case is based on the contract between you and Boxia.

 

Service development and research

We may use Personal Information to improve the quality of the Service, to solve problems detected within the Service and to develop better features for the Clients. We base this processing on our legitimate interest to improve the Service and its features and content. We may also generate anonymous, aggregate statistical information for research purposes, including business intelligence.

 

Marketing and communications

We may use personal data to send you relevant information about the Service. Personal data may also be used for the purposes of advertising, marketing, direct marketing and personalized marketing to Clients and/or Users. We may create general profiles of the Clients and/or Users to provide more relevant content and advertisements. We base this processing on our legitimate interests to keep the Clients and/or Users up-to-date about the Service and to market relevant new products and services to the Clients. The Client and/or User has the right to prohibit direct marketing at any time.


5. Where we store your Personal Information

The information that we collect from you is stored in France. This information may be transferred to, and stored and processed at, a destination outside of France or other countries that we choose to use. By submitting information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Policy. We have created a Data Processing Agreement (DPA) to meet the requirements of the GDPR in order to permit our Clients to continue to lawfully transfer EU personal data outside of the EU.


6. Sharing of your Personal Information

We may disclose personal data to third parties:

  • when permitted or required by law;
  • when our trusted service providers provide services to us on behalf of us and under our instructions. However, we will control and be responsible for the use of the Client’s personal data at all times;
  • if Boxia is involved in a merger, acquisition, or sale of all or a portion of its assets;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect the Client’s safety or the safety of others, investigate fraud, or respond to a government request.

Boxia does not sell personal data of Clients and/or Users to third parties.


7. Protection of your Personal Information

Your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but we cannot guarantee complete security. The transmission of information via the internet is not completely secure. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

When you enter your information on our site we encrypt the transmission of that information using secure socket layer technology (SSL). The Website and Software may contain links to other websites. We are not responsible for the privacy policies and/or practices on other sites. When following a link to another website you should read that site’s privacy policy.


8. Changes to this Privacy Policy

We may amend this Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes or changes in the way we use Personal Information, we will notify you by posting an announcement on our Website or Software, or sending you an email prior to the change becoming effective. You are bound by any changes to the Privacy Policy when you use the Website or Software after such changes have been first posted. It is strongly recommended to check this page often, referring to the date of the last modification.
